Miller has denied injuring either Moreno or their daughter and has accused his ex-wife of fabricating the allegations.

He has pointed to an April letter closing an investigation into the child’s injury after the accusation was deemed unsubstantiated.

Miller and Moreno married in August 2022, welcomed their daughter in November 2023 and divorced in June 2025.

They now have restraining orders against each other as their custody battle continues.

Moreno also recently sought another order barring Miller from contacting her lawyers after alleging that he grabbed one of her attorneys during a court hearing.

Senator Moreno also said that Miller’s “increasingly erratic and dangerous behavior” had made it impossible for the family to continue handling the dispute privately.

“If there are any basic standards of character required to hold elected office, Max Miller fails them,” Moreno wrote on X.

“He should not serve in the House of Representatives.”

Moreno called Miller “a danger” to his daughter and said the congressman needed “serious psychological help.”

“It has been horrific to watch this play out in full public view, all while knowing an innocent 2-year-old girl is caught in the middle,” he said.

The senator then revealed Tuesday that he had personally collected his granddaughter from Miller at a police station during a custody exchange.

Moreno claimed Miller initially refused to hand over the toddler’s favorite stuffed blue bunny, leaving her unable to sleep without it.
