He was kept alive in the days after birth by doctors in Texas, but is now in critical condition.

The baby was diagnosed at a 20-week scan, when parents Nasheen and Omar decided they wanted to end the pregnancy because of the rare congenital condition.

Alaska surrogate McKenna refused to go through with the abortion and fled to Texas, where abortion is illegal.

The biological parents won custody of baby Rumi in California and are fighting in court to enforce a restraining order against the surrogate, as well as against a custody filing by McKenna in Texas.

Biological mum Nasheen tearfully told a Dallas court on Tuesday: “She’s making us run from doctor to doctor, state to state. With our baby – she’s trying to take him.”

She said she had been through eight unsuccessful rounds of IVF and had to have a hysterectomy, adding that surrogacy was her “only option” after her body “gave up”.

Nasheen said: “We’ve never wanted anything more than this baby.”
